Terms of Service

These Terms of Service ("Terms") govern your use of Kaptik, operated by Tyson Lee Crisp, trading as Kaptik.com (ABN 79 165 876 262) ("Kaptik", "we", "us"). By creating an account, listing products, or buying through a Kaptik storefront, you agree to these Terms.

1. The service

Kaptik is a platform that lets creators ("Sellers") sell digital products, courses, memberships, license keys, bundles, and booked sessions to buyers ("Buyers"). Kaptik provides the storefront, checkout, delivery, and marketplace infrastructure. Products are sold by Sellers, not by Kaptik. The contract of sale for any product is between the Buyer and the Seller.

2. Fees and payments

• Kaptik charges Sellers a platform fee of 5% of each sale. Payment processing is handled by Stripe; Stripe's own fees and terms also apply.
• Funds settle to the Seller's connected Stripe account. Kaptik never holds Seller funds beyond the platform fee.
• Fees may change with 30 days' notice; changes never apply retroactively.

3. Taxes

Sellers are solely responsible for determining, collecting, reporting, and remitting all taxes that apply to their sales — including GST, VAT, sales tax, and income tax in every jurisdiction where they have obligations. Kaptik does not calculate, collect, or remit taxes on Sellers' behalf and provides no tax advice. Prices shown at checkout are the amounts charged; whether they are tax-inclusive is the Seller's responsibility to determine and disclose.

4. Seller obligations

• You must own or have the rights to everything you sell.
• Product listings, landing pages, and marketplace pitches must be accurate and not misleading.
• Sessions sold as bookings must be honoured at the booked time, or canceled with reasonable notice and refunded on request.
• You are responsible for honouring your own refund policy and for any consumer-law rights your Buyers have (including the Australian Consumer Law where it applies).
• If you use the ad pixel feature, you are responsible for the legality of your tracking and advertising, including any disclosure or consent your Buyers' jurisdictions require.

5. Prohibited content and conduct

You may not sell or promote:

• anything illegal, stolen, or infringing others' intellectual property;
• malware, hacking tools intended for unauthorized use, or deceptive software;
• adult content involving minors in any form, or non-consensual content;
• get-rich-quick schemes, fake reviews or engagement, or products you cannot deliver;
• weapons, drugs, or other regulated goods.

We may remove listings, suspend marketplace access, or terminate accounts that break these rules, with or without notice depending on severity.

6. Marketplace and affiliates

Marketplace listing is subject to review and approval, which we may grant, refuse, or revoke at our discretion. Affiliate commissions are set by the Seller and paid by the Seller; Kaptik records attribution and commission amounts but is not a party to the Seller–affiliate relationship.

7. Refunds, disputes, and chargebacks

Our Refund Policy explains how refunds work. Chargebacks filed with a card issuer are resolved through Stripe's dispute process; access to disputed products is revoked while a dispute is open.

8. Accounts

You are responsible for your account credentials and for everything done under your account. We may suspend accounts that present a security, legal, or fraud risk. You may close your account at any time; obligations that accrued before closure (fees, refunds, taxes) survive it.

9. Intellectual property

Sellers keep all rights to their products and content, and grant Kaptik a licence to host, display, and deliver that content as needed to operate the service (including marketplace listings and search previews). Kaptik's software, branding, and design remain ours.

10. AI features

AI features run on API keys Sellers supply ("bring your own key"). Sellers are responsible for their AI provider costs and for reviewing AI-generated content before publishing it. AI output is provided as-is.

11. Disclaimers and liability

The service is provided "as is" without warranties beyond those that cannot be excluded by law. To the maximum extent permitted by law, Kaptik's total liability to you for any claim is limited to the platform fees you paid us in the 12 months before the claim arose. Nothing in these Terms excludes rights that cannot be excluded under the Australian Consumer Law or other applicable law.

12. Changes and governing law

We may update these Terms; material changes will be notified to account holders with reasonable notice. These Terms are governed by the laws of Victoria, Australia, and disputes belong to the courts of that jurisdiction.
